Electronic Volumes (e-books)
The Electronic Books (e-books) are in PDF format encrypted using third
party software, which includes a plug-in. Each licensed e-book can be installed
on not more than THREE computers. The technology locks the e-book to the PC
where the file is opened first. An e-book can be opened for the FIRST time only
online, that is with internet connection where the prompt will be for username
and password.
Each e-book has a monthly limited print quota. Printing will be allowed only
online, that is, with internet connection.
Data Export
You agree that your use of the Electronic Books and Print Volumes will comply
with all applicable laws, rules and regulations that govern the export of data.
Links to Other Sites
UNESCO and Encyclopedia of Life Support
Systems (EOLSS) do not accept responsibility for the content or
availability of other sites that are accessed via links that may appear from
time to time on the UNESCO-EOLSS-Online site.
Destructive Devices
It is your responsibility to take precautions to ensure that your computer
and/or network is protected from worms, viruses, Trojan horses, or any other
devices with destructive intent. In no event will UNESCO and
Encyclopedia of Life Support Systems (EOLSS)
be liable for any direct, indirect, special, incidental, or consequential
damages to you from the use of the UNESCO-EOLSS-Online.
Law, Jurisdiction and Venue
This Agreement shall be construed and
interpreted pursuant to the International Law, the
laws of other countries (parties to international
copyright treaties) and United Nations Convention on
Contracts, without reference to any conflict of law
principles. Any legal action, suit or proceeding
arising out of or relating to this Agreement or the
breach thereof shall be instituted in a court of
competent jurisdiction under the International Law,
the laws of other countries, and United Nations
Convention on Contracts and each party hereby
consents and submits to the personal jurisdiction of
such court, waives any objection to venue in such
court and consents to the service of process by
registered or certified mail, return receipt
requested, at the last known address of such party..
Compliance with Laws
Encyclopedia of Life Support Systems (EOLSS)
endeavors to ensure that the EOLSS-Online complies
with the requirements of the International Law, as
well as the foreign laws of any country where it is
intended for the EOLSS-Online to be viewed. In the
event that a foreign country's law may not be fully
satisfied, then Encyclopedia of Life Support Systems
(EOLSS) shall be deemed not to be directing the
EOLSS-Online to that particular country.
Indemnification
You hereby indemnify, defend, and hold UNESCO and
Encyclopedia of Life Support Systems (EOLSS) and our
affiliates and our officers, directors, employees, agents and representatives
(collectively, the "Indemnified Parties") harmless from and against any and all
liabilities and costs (including reasonable attorneys' fees) incurred by the
Indemnified Parties in connection with any claim arising out of any breach by
you of this Agreement. You shall use your best efforts to cooperate with UNESCO
and Encyclopedia of Life Support Systems (EOLSS) in the defense of any claim.
Encyclopedia of Life Support Systems (EOLSS) reserve the
right, at their own expense, to assume the exclusive defense and control of any
matter otherwise subject to indemnification by you.
Limitation of Liability
UNDER NO CIRCUMSTANCES, INCLUDING, BUT NOT LIMITED TO, NEGLIGENCE, SHALL
Encyclopedia of Life Support Systems (EOLSS) BE LIABLE FOR ANY DIRECT, INDIRECT, SPECIAL, INCIDENTAL, OR
CONSEQUENTIAL DAMAGES THAT RESULT FROM THE USE OF, OR THE INABILITY TO USE, THE EOLSS-ONLINE OR MATERIALS OR FUNCTIONS ON THE Electronic Books and Print
Volumes, EVEN IF Encyclopedia of Life
Support Systems (EOLSS) HAVE BEEN ADVISED OF THE POSSIBILITY
OF SUCH DAMAGES. IN THE EVENT APPLICABLE LAW DOES NOT ALLOW THE LIMITATION OR
EXCLUSION OF LIABILITY OR INCIDENTAL OR CONSEQUENTIAL DAMAGES,
Encyclopedia of Life Support Systems (EOLSS) TOTAL LIABILITY TO YOU FOR ALL DAMAGES, LOSSES, AND CAUSES OF ACTION
WHETHER IN CONTRACT, TORT (INCLUDING, BUT NOT LIMITED TO, NEGLIGENCE), OR
OTHERWISE WILL NOT EXCEED THE AMOUNT PAID BY THE LICENSEE, IF ANY, FOR
ACCESSING THE Electronic Books and Print Volumes.
Limitation of Claims
The user must bring any action on any claim against
Encyclopedia of Life Support Systems (EOLSS) within six
(6) months following the date the claim first accrued, or it shall be deemed
waived.
General Provisions
If any of these Terms of Use shall be unlawful, void or for any reason
unenforceable, then that provision shall be deemed severable from these Terms
of Use and shall not affect the validity and enforceability of any remaining
provisions.
